Terms of service & acceptable use

These terms govern the Polder Mac service between you and PPR-TEAM BV (Graslei 6, 9000 Gent, Belgium; enterprise number 0865.862.976). By sending a request you agree to these terms, the refund policy and the privacy policy.

1. The service

We rent out physical Mac mini computers hosted in Gent, Belgium, which you use remotely over the network. For your whole term, the machine is used by you alone. Terms last 1, 3 or 12 months and start when we deliver your connection details.

2. Requests and review

• You must be at least 18 and give true, accurate information.
• A person reviews every request, and we may decline one without giving a reason.
• A request is not a contract. The contract is formed when your payment succeeds.

3. Prices and payment

Prices are in euros and include 21% Belgian VAT. You pay by card through Stripe, and we issue an invoice after payment. Terms do not renew automatically. To continue, send a new request.

4. Your responsibilities

• Keep your account and machine login details safe, and change the machine password as soon as you first log in.
• You are responsible for everything on the machine and everything done with it.
• Back up your own data. When your term ends, we wipe the disk and the data cannot be recovered.
• Follow Apple's macOS licence and the licences of any software you install.

5. Acceptable use

You must not use the machine to:

• Create, store, share or obtain any child sexual abuse or exploitation material. If we find it, we stop the service immediately, preserve evidence and report it to the Belgian Federal Police.
• Spread malware, or attack, scan, brute-force or access other systems without permission.
• Send spam, phish, defraud or impersonate anyone.
• Infringe copyright, trademarks or other intellectual property.
• Mine cryptocurrency, or saturate resources in a way that harms the network.
• Sublet, share, lend or resell the machine or access to it.
• Get around our security measures or logging.
• Do anything that breaks Belgian, EU or your local law.

6. How we handle misuse

• We do not look at the files on your machine, but we keep connection logs (time and source IP).
• When we receive a report or an order from the authorities, or see clear signs of illegal activity, we suspend or end the service immediately.
• If the service ends because you broke these rules, we do not refund what you paid.
• We share relevant information with the authorities when the law requires it.

7. Availability

We work to keep machines online but cannot promise there will never be an interruption. We try to announce planned maintenance in advance. Outages caused by us are compensated under the refund policy.

8. Limitation of liability

As far as the law allows, we are not liable for indirect loss, lost profit or lost data, and our total liability is capped at what you paid for the term concerned. This does not affect consumer rights that cannot be excluded by contract.

9. Changes

We may update these terms. We will give notice of significant changes, and terms already paid for continue under the terms that applied when you paid.

10. Governing law

Belgian law applies. The courts of Gent have jurisdiction, without affecting the protection consumers have in their country of residence. EU consumers can also use the EU online dispute resolution platform.
